GENERAL TERMS AND CONDITIONS

1. Introductory Provisions
1.1. These terms and conditions (hereinafter "Terms and Conditions") of the sole proprietor:

Registered in the Trade Register (hereinafter "Seller")
regulate, in accordance with § 1751 paragraph 1 of Act No. 89/2012 Coll., the Civil Code (hereinafter "Civil Code"), the mutual rights and obligations of the contractual parties arising in connection with or based on a purchase agreement (hereinafter "Purchase Agreement") concluded between the Seller and another natural person (hereinafter "Buyer") through the Seller's online store.
1.2. The online store is operated by the Seller on the website located at [www.epoxyart.cz] (hereinafter "Website"), through the website interface (hereinafter "Store Interface").
1.3. Provisions deviating from these Terms and Conditions may be agreed in the Purchase Agreement. Such deviations take precedence over the Terms and Conditions.
1.4. Sales specifics: The Buyer acknowledges that the Seller ensures the sale of goods in cooperation with external warehouses and suppliers. Goods may be delivered directly from a partner warehouse of the Seller, while the contractual relationship and responsibility for delivery remain with the Seller.
2. User Account
2.1. By registering on the Website, the Buyer can access their user interface. From their interface, the Buyer can place orders.
2.2. The Buyer is obliged to provide correct and truthful information. The Buyer must update the information in their user account whenever it changes.
3. Conclusion of Purchase Agreement and Nature of Goods
3.1. The presentation of goods on the Store Interface is for informational purposes only, and the Seller is not obliged to conclude a purchase agreement regarding such goods.
3.2. Custom packages: The Store Interface allows the Buyer to configure material sets (hereinafter "Packages") according to specific parameters (area, surface type, color). If the Package contains material that must be individually tinted, mixed, or otherwise modified for the Buyer, it is considered goods customized according to the consumer's wishes.
3.3. The contractual relationship between the Seller and the Buyer arises upon delivery of the order acceptance, which is sent by the Seller to the Buyer via email.
4. Purchase Price and Payment Terms
4.1. Prices of goods include VAT and all related fees. Prices remain valid as long as they are displayed on the Store Interface.
4.2. In addition to the purchase price, the Buyer is obliged to pay the Seller the costs related to packaging and delivery of goods at the agreed rate.
5. Transport and Delivery of Goods (DELIVERY WARRANTY)
5.1. If the shipping method is agreed upon based on a special request of the Buyer, the Buyer bears the risk and any additional costs associated with that shipping method.
5.2. Inspection upon receipt (IMPORTANT): Upon receiving goods from the carrier, the Buyer must carefully check the integrity of the packaging. Any defects (dents, leaks, damaged boxes) must be reported immediately to the carrier and a Damage Report must be made, or the shipment should be refused.
5.3. By signing the delivery note without reservations, the Buyer confirms that the shipment met all packaging conditions, and any later claims regarding damaged packaging or mechanical damage caused during transport will not be considered.
6. Withdrawal from the Agreement
6.1. The Buyer (consumer) generally has the right to withdraw from the purchase agreement within fourteen (14) days of receiving the goods.
6.2. Exceptions to the right of withdrawal: The Buyer acknowledges that, pursuant to § 1837 of the Civil Code, it is not possible to withdraw from a purchase agreement for goods that have been customized according to the Buyer's wishes or prepared for the Buyer.
Note: This exception applies to all epoxy resins, paints, and coatings mixed or prepared in a specific color or quantity according to the Buyer's order. Such goods cannot be returned.
6.3. For standard goods (tools, transparent resin in original packaging without tinting) that have not been opened or used, withdrawal is possible within 14 days. Goods must be returned undamaged and unused.
7. Rights Related to Defective Performance and DISCLAIMER OF APPLICATION LIABILITY
7.1. The rights and obligations of the parties regarding defective performance are governed by generally binding legal regulations.
7.2. The Seller guarantees that the goods are free of defects upon delivery (e.g., not expired or the correct type was delivered).
7.3. DISCLAIMER OF APPLICATION RESULTS: The Seller expressly warns that they sell construction chemical materials, whose final properties and appearance depend on proper application. The Seller is not responsible for defects, surface appearance, insufficient curing, bubbles, cracks, or color deviations caused after application if they result from:
a) Failure to follow the manufacturer's technical procedure (especially incorrect mixing ratio of components A and B).
b) Application under unsuitable climatic conditions (substrate temperature, air temperature, humidity, dew point).
c) Improper substrate preparation (concrete moisture, grease, dust, loose substrate).
d) Use of improper tools or unskilled handling.
7.4. Claims regarding color or material quality must be made before mixing and application. After mixing or application, claims based on dissatisfaction with color or appearance cannot be considered, as it is an irreversible chemical process affected by external factors.
7.5. Material consumption indicated in calculators or product descriptions is approximate and assumes an ideally flat and non-absorbent substrate. Higher consumption due to substrate absorbency or unevenness is not considered a defect.
8. Other Rights and Obligations of the Parties
8.1. For out-of-court resolution of consumer disputes from the purchase agreement, the relevant authority is the Czech Trade Inspection Authority, Štěpánská 567/15, 120 00 Prague 2, ID: 000 20 869, website: https://adr.coi.cz/cs.
9. Data Protection
9.1. Information on personal data processing is provided in a separate document "Privacy Policy" available on the Website.
10. Final Provisions
10.1. If the purchase agreement involves an international element, the relationship is governed by Czech law.
